In theory, a Last Will and Testament is written to prevent disputes over the division of property after a decedent’s death. Most people write wills to benefit family members, settle tax issues ahead of time, and get the maximum benefit out of all the assets. Unfortunately, even the most carefully drafted will can be disputed after a person’s death, often by well-meaning family members.

There are a number of reasons a will may be disputed. A family member might claim that a person was not mentally fit to sign a Last Will and Testament. They might assert that someone exercised undue influence over the decedent, causing them to reject a family member or make unequal property distributions. There may also be allegations of fraud, elder abuse, a breach of confidence by a lawyer or fiduciary, or the abuse of a power of attorney. Finally, a Last Will and Testament may not have been written, signed, and/or witnessed in accordance with Florida law.
